EB3-I dates are in Oct 01, there are no cases to approve, what will they approve?
What makes you think they are processing EB2-I more? Same logic applies here. Wait for the next bulletin, if you are EB3-I in 02 you'll get what is long overdue?
If thats the case then why don't they move the PD forward. EB3-I is stuck in 2001 since last 3 years and its not moving forward at all. How can we get some help here, ombudsman?

This situation may happen for many people. Now EB2 persons need to prepare for this situation because of PD movement. Also EB3 people also need to prepare for this situation in case recapture bill is passed. For chances of passing recapture bill is 50% and if it is passed it will be swift and fast.

No. The way I understand it, the new employer is offering you a permanent job in the same/similar job classification. So you work for the new employer in a permanent capacity after you receive the green card.
I have a question....Green card is for future employment.In that case,once your I-485 got approved ,you need to go and work for your original employer who sponsered your green card. Is that right? Is that the same case if someone uses AC21?

H1Bs approvals gets the government Millions of Dollar every year and if they can use the money to improve DHS there is no need for this addl price increases.
Think abt this any given year 85000(65000 regular + 20000 Advanced Degrees) new H1Bs approved. Atleast 50000(if not more) more are either extended or transferred. USCIS charges $2185 per application.
See the final numbers 135 000 X 2000 (approx) = 270 million dollars per year. IF they use all this money on USCIS & DHS programs we would have had a better system. Obviously all this money is going somewhere and that explains all the difficulties and frustrations we face with this BROKEN Immigration.

I may have to respectfully disagree with this.. Mine was approved on June 13th 2006 and my PD is current.. I have seen many EB2 with a later PD and 140 approval being approved.
There is only ONE trend... that is NO TREND :p

Most of the state colleges, (In my case, none of the state colleges), including under-grad and medical schools, will accept application, if you do not have GC/ US citizenship. I tried, wrote letters, but of no use.
You can apply and get admission in private college, which of course cost much more.
Also, we were not able to take any federal loans.
Hi Dinesh, in your quote above were you intending to say that most state colleges WILL NOT accept applications if you do not have GC/citizenship? So to attend a state college you NEED TO BE a GC holder/citizen? If that is the case how come lot of international students come here and attend state colleges for MS/Phds and get assistanships/fee waivers?

so, now they have bumped up EB3 ROw, does that mean they will bump up EB2 or EB3 India next month? The fact that EB2 and EB3 India are stuck, does it mean these categories have already reached their per country annual limits?

There is a petition to capture lost visa. If lost visas are recaptured, there will be some relief.
At least that would definetely help. Apparently over the past 5 years they have lost 180,000 visas just becuase.

I know we had lot of discussions about Notice date and reciept date.I was planning to invoking AC-21 after 180 days.My application reached USCIS on Jul 18th.I assume this is when the 180 days count down starts.My notice date is Sept 18th.(Checks cashed).My online status for my 485 is as follows
"On September 18, 2007, we received this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS, and mailed you a notice describing how we will process your case.Blah blah"
When they recieved, do they mean it is the reciept date.My 180 days ends on Jan 18th 2008.

4. property papers on joint name
5. other investments on joint name might help.
6. Indian passport has spouse's name entered
7. "Lease papers"
8. "Medical insurance papers with name of the spouse"
9. joint tax filed as additional proof.
10. Her H4 stamping etc can be a proof too
I am now trying to come up with a affidavit format that I need to send to some folks in India who attended our wedding and get those too... I will keep you all posted..

All our passport renewals (4 during last 3 years) happened in a timely fashion and that too thru post without any personal visit. Just imagine what will happen to the market flooded with EADs. Job market for H1Bs will totally be down. No US companies will hire H1Bs if they get somebody with an EAD. Tonnes of Junior developers and S/W testers will in the market driving the billing rates down even further. It's better to pack up and leave. I have heard from one of the forums here that an estimated 500K people will file this month since all PDs are current. EB-3 mexico + phillipines togther alone will be close to 300K. God help the Job market.
Also minimum wait time will be 500K/140K ~ 4 yrs before they get to process your GC. Add to that the time for namecheck backlog 2+ yrs. So total 6+ yrs before getting GC........

Isnt that how a market is supposed to work - on the laws of demand and supply. For every consequence there is always an unintended one. And if enought local wokers (EAD, others) are available then the laws of the market would require an automatic reduction in the number of H1b's.
Before people start dumping on me - lets remind ourselves that we are here for a healthy debate and to appreciate ALL view points.
Remember - It is not that important to know all the answers as it is to ask the right questions.

I dont think so. I believe that EB3 I would get the bare minimum they should get in a year if not more.
I am not tracking approvals rate as such. But if, CIS hasn't used as many numbers have DOS reported, then as Ron suggested, dates will move forward for EB3 Ind.
