Folks,
Let us focus on the rally and recapture of visa numbers. This more important to all than fighting out the LS issues and finding fault it is not our issue. If the LS guys gets rejects, they deserve it for not using their own Labor, and they a price for the same. Let us not beat them with a stick and focus on what can be done now.
Let us not build hatred against anyone, this can only undermine our efforts. You never know, heard FBI Checks are strict on LS folks, hope that is true, atleast genuine filers get it based on their PD, so be 2001 or 2002 as long as they are the original beneficiary.

I know before you start blaming me for this thread, as it is of no use, I would like to point out that most of you must be experiencing the same thing. I didn't care much for Visa bulletin until it became current for EB2 two weeks back. As the time progress, I am doing all sorts of things, like checking USCIS case status, and checking everything that can possibly give me some information. I know that it is waste of time, I know it is not good for health, I know that I will get GC when time comes, but still, my mind is tricking me to think about it. I checked all these forums until 2A.M last night. I am not having enough sleep. I am waiting for a opportunity to get rid of my desi employer. I am really getting frustrated (I am not saying that I have been waiting for GC approval desperately). I just want to share my frustration and what I have been going through. I know I am in a better position than most of other people whose priority date is not even current. I wish they never dangled a carrot in front of me. I am not sure if they disappoint me next month, but I am still keeping my hopes. Hopefully, I would get over this and have enough sleep from today.

As Dalai Lama (with no offense to our Chinese friends on the forum) recently said - Proper Sleep and drinking proper amount of water daily is fundamental aspect for living long and healthy life. Thanks to alergro for pointing out that there is more to cherish and be happy for, and that applies to all of us. Although this issue does affect our lives and every few days we get out of our normal daily routine and think more about future plans, then all of a sudden we see GC roadblock stopping our every plan/progress, and we tend to become extra worried about it, go out searching for all the knowledge available to answer our questions, and in the process become worried and spend a few sleepless nights. It seems that this may be happening in your situation too, just a guess. If the answer is yes, then you have come to the right place and there are many more in the similar situation here. They may not admit this, they may be rude or nasty to you taking offense from the words you chose to post/reply on this forum, or sometimes you take an offense from what they have to say to you, but we are all in the same boat under similar circumstances. If nothing else, atleast that's the consolation you can take from this thread.

And Best is not just GDP, Romania hast 4 times more GDP per capita compared to India, but I don't see my self going back there. Coruption, stupid mentality, etc. dis will not change with GDP growth, to change the mentality of the people you need a couple of generation to die until you get somwhere close to USA.:(
I agree with you on that. But the US is not on the right track when it comes to skilled immigration and it may cause severe problems for it later. Already smart kids in India/China don't mind staying home with the life/salaries and work opportunities. Things are changing and the US better get its game up or innovation will slowly shift overseas.

The first thing to do in call your attorney and ask him to be with you when any uscis or ice guy shows up. Right to an attorney is a basic right. Do not think that u will offend ice officer if u have u'r attorney present. Do not think that u'r charming personality will put u in the good books of ice. If I were u, I would not do anything, without consulting my attorney in such a matter.
Also, keep bank stmts and all recent paystubs handy, along with past exp. Letters and degree/certificates. Copiew of h1 + gc petition/approval would be good to have.

Copanies like INFOSYS are not the culprits. This is going tangenatially. It is the local small desi body shops that suck blood and hold candidates life in their hand because of GC. They should be investigated.
I think they have to pay the minimum wage as declared in their petition.
But I doubt whether they even send those employees on assignments. I guess they process these H1s as a carrot to retain the employees or to preprepared for any future assignments (they may not even come and the visas are never used)...
Wish there is a different category of visas for outsourced kind of work so that H1s can be used by America based companies and H1 is not seen in such a bad light.

This is not to oppose your message - I am just trying to figure out where these arguments comes from because I don't think I believe in this whole fraud thing. AC21 is meant for one to change jobs after working for the original sponsoring company for 180 days. Also, there are no clear guidelines stating that one must inform the USCIS - so what will this fraud be based on? How can one be committing fraud if there are no guidelines to tell you what is considered fraudulent? I think one is fraudulant when one actually violates some set rules etc. I don't think the USCIS can have a basis for suspecting someone of fraud when they don't even have a definition of what may constitute fraud in this case because of the lack of guidelines. Plus, I have never, ever heard of anyone be denied or suspected of anything like this during citizenship, I just don't believe this is a factor AT ALL. I see these comments a lot and they just don't make any sense to me. To me, it is like breaking a law that doesn't exist. And you say one may be "suspected", well, suspicion is just that, suspicion. The USCIS needs to show proof that you intended to be fraudulent and for as long as there are no AC21 guidelines that tell you that you must inform the USCIS upon invoking AC21, the USCIS will not and cannot have a case against you.
The disadvantage of not filing for AC21 is if your AoS is approved with USCIS believing that you will be working for the original petitioner after approval.
That is the disadvantage. USCIS will not know that you intended to port to new employer by invoking AC21 and come the time your apply for Naturalization, USCIS will discover it and may suspect you of fraud.

If I went back there I could have a top job with a top company (and have had many offers) but that is not a place where I'd like to raise a family.
Before the US I almost moved to China, but then I got the US job offer. I now have the Canada option, but I wouldn't mind moving to India. I have lots of Indian friends and I think Indians are easily one of the very nicest people in the world while being smart too (not conceited), plus they speak English. (Nothing against China, but it would take me at least 3 years to learns OK Chinese)
Anyone have any advice about finding a job in India? (I am serious) I have to have options since my home country is not an option, and in case Canada doesn't work for me. If anyone can give me information on moving to India I would really appreciate it. Thanks!

Its not only for illegals but its also for kids of legals that aged out due to retrogression or backlogs in visas...plz don't be selfish with view points like "it doesnt help us so im gonna oppose it"....instead help the children who aged out due to the visa backlogs!!! Yes might be but Labor cert is not being part of list of docx that need to be attached even if ur 140 is pending as if you would have included I-140 receipt notice but in your case it seems better u do it rather feel sorry . But refiling in many normal cases wont help much unless if there is an issue in it.
I would not re-submit only for EVL, but it is important you review your entire AOS application set that went out to USCIS.
I reviewed the photocopies of our AOS applications and found a few omissions e.g. not including
1. EVL
2. pending I-140 receipt notice
3. Labor cert approval which would clearly show the priority date-- instead they put a wrong priority date in the covering letter.
I decided it is a higher risk to rely on such a messed up application!
Hence, I am working to re-submit our AOS. I asked that I review the entire application in advance this time around:) Thanks IV... I have come a long way because of YOU!
BTW a small issue I found on my family's AOS applications:
For my dependants... in Part (2) Application Type, I think we should check (b) my spouse or parent applied for....
it is currently (a) an immigrant petition giving me....

you can get medicals in 2 hours.
Not sure if this is chicago/pittsburgh.
your only option is to find out by calling all numbers in chicago and pittsburgs.
People have flown in from various locations into chicago and got medicals in 2 hours.
also, ask your wife to get the immunization record of mmr and tetanus.
that will make your life easier.
x-ray is mandatory.

x-ray is not a must and it's need only if the skin test result is +ve.
