I hope, Skil bill has the provision to lost recapture visa numbers. If the big news Monday benefits us in having AOS filed, then we are looking at recapturing visa numbers anyways.
Why not lobby for it ? If Dream Act can pass as ammendment in Defense Policy Act, why not SKIL Bill ?
If they can attach Dream Act as an amendment to the Defence policy Act why cannot they attach SKILL to the same. That is the question we should be acting on.
I think expecting Sen. Cornyn to do something now is kind of remote. He is going to be facing elections soon in 08. May be Cantwell is the one to do it.

In a matter of minutes my indicator has gone to 3 reds. Am I missing something... ?!!!
Dont worry too much about the reds. Even I used to have a couple of greens.
But when I saw many people complaining about why IV is not pursuing piecemeal,
I explained them about the Hispanic caucus and CIR.....I started getting reds
because of that.
People often give red even for rational and logical postings here if the information is uncomfortable.

The best thing DOL did was to get rid of Labor Subs. Period.
Why:
1. I've paid Social Security taxes + Medicare + Income taxes longer than people who've come here in 2006 and used LS. If I don't get GC (frustration due to retrogression), aren't these guys enjoying (or going to enjoy) benefits that I've paid for, for a longer time.
2. It's really no different than the system in India (or what used to be)for getting everything from telephone, passport etc. where a select few jump ahead in line by either knowing somebody or paying somebody. Isn't that one of the reasons a lot of us decided to move to the US for better(fairer?) opportunities.
3. Isn't this very similar to the falsifying of experience people do to get better positions in a company?
4. Yes, I do have a problem if after slogging my butt off to get a Ph.d, somebody with 3 yrs + 2yr of NIIT comes in through desi consultancy and gets far ahead in line than me. Now before somebody says NIW+ EB1, let me tell you that it's not that easy to get it in the Computer Sciences.
Anyway, having said that it's no time to be divided, but to present an unified front in getting legislation passed that eliminates exactly this kind of discussion. Atleast 20 yrs down the line when we talk about arranging marriages between our children, let how we got GC be a deciding factor in who's got the bigger status :D

I am in a similar situation and have a very simple question. Can I port from EB3 to EB2, while on EAD? I do not have a valid H1. AFAIK porting needs re-filing a labor application, hence the confusion.

That post was intended towards EB3 category, particularly EB3-India. Ever since starting of this Fiscal Year there are very few EB3-India approvals (Can anybody dispute that?). So how come USCIS used up all the visas already?? Most of the guys here always talk about EB2-India which is not highly effected category in the first place. We suppose to be taking care of effected categories.
I have a friend of mine with PD July 2001 (EB3 Ind) with NC cleared. His GC is not cleared despite his date being current for few months now.
Who is saying USCIS is doing diligence? If they were, dates cannot move forward so much for EB2 Ind and EB3 ROW.

Gotta love this system...
Two years ago; Grassley sent a questionnaire to the top 10 Indian outsourcing companies of how they use non immigrant visas.
They did not have any legal obligation to answer his query. They answered his questions by non answering it.
Grassley then starts to increase the rhetoric and starts pressuring uscis/dol to start investigations.
uscis/dol start investigatin and denying cases and study it and find fraud.
now; Grassley is getting his way and starting to change policy.
Nascom senses game is over and come begging which is exactly what grassley wanted in the first place.
At the end; he will get these guys to agree to tough measures (ie., lca requirements for L-1; tougher measures on h-1b, etc.
See how Microsoft answered differently when they got the query and compare to these guys.
This system created in USA has a way of making you conform to their behaviour willingly or through long and painful way. Looks like they had to learn through long and painful way.

Dhundhun, to answer your question...no I do not intend to break the contract. I just want to protect myself from any mishap in future. By the way as I mentioned earlier, the contract is not of 12 months....its for ENDLESS time. It says that if I leave the company anytime...I will need to refund all the training costs that the company would of incurred in last 12 months.
