I filed my I-485 (Nov 2004 EB3), but my old labor ( EB3 Mar 2003) got cleared. I am going to apply another labor in EB2 and move this EB3 priority date to that EB2, that way my case will be current.
Not very much sure about its possibility, any suggestions.
But coming back to the point, you are in a better boat by not filing, you can atleasr make it as EB2 and get the Green card Faster.

Even if I back date my marriage (as advised) , How can I get my future wife to USA?. I cannot get her on depend status as my H1-B (I believe) got canceled on approval of GC.
Issues I see,
1. The back date of marriage must match to my stay at India.
2. I did not visit India in the last one year.
3. I applied my I-485 in the August 2008 time. So (I must mention my marriage and dependents in the application). Which I did not . So this does not work.
See the troubles I have now.
P.S: I did not want to cheat USA Immigration Dept. Not a good practice

Don't even think about that, unless you want to go to jail. They can easily find out if you were staying in US while your marriage tookplace in India.

Guantanamo may be kept open just for us .... and they will charge us $5000/$10000 per extension which is due per year ;)
I thought Guantanamo was being closed soon. They might ship us to detention centers in Afganistan or Iraq. :D Hope they have more high tech jobs there.

DREAM Act Loses Republican Cosponsor Richard Lugar
WASHINGTON -- Senate Democrats reintroduced the DREAM Act on Wednesday without the co-sponsorship of Sen. Richard Lugar (R-Ind.), who had previously been one of the bill's strongest backers.
The legislation would allow some undocumented young people to become U.S. citizens and has been introduced repeatedly over the years with Lugar and Sen. Dick Durbin (D-Ill.) as the cosponsors. The most recent vote on the DREAM Act was in December, when it fell five votes short of bypassing a filibuster. Lugar was one of just three Republicans to vote for the measure.
In a statement, Lugar spokesman Mark Helmke blamed Democrats for turning immigration into a partisan issue.
"President Obama's appearance in Texas framed immigration as a divisive election issue instead of attempting a legitimate debate on comprehensive reform," wrote Helmke. "Ridiculing Republicans was clearly a partisan push that effectively stops a productive discussion about comprehensive immigration reform and the DREAM Act before the 2012 election."
In his Tuesday speech at the Mexico-U.S. border, Obama pointed the finger at Republicans for moving the goal posts on immigration reform. The president argued that his administration has gone out of its way to accommodate their requests.
"Maybe they'll say we need a moat. Or alligators in the moat," Obama joked, referring to the GOP. "They'll never be satisfied. And I understand that. That's politics."
Helmke said Lugar's staff told Democrats that the Indiana senator supported the initiative, but he wanted them to work on getting more Republican support. Lugar's spokesman claims that not only did Democrats not do that, but they set up a press conference to announce the reintroduction of the DREAM Act before the Lugar had made his final decision not to cosponsor. Democrats, however, said that it was clear for months that Indiana Republican wasn't going to cosponsor the bill at this time.

Read the two stories for break.
THE BEST LAWYER STORY SO FAR
One afternoon a lawyer was riding in his limousine
when he saw two men along the roadside eating grass.
Disturbed, he ordered his driver to stop and he got
out to investigate.
He asked one man, "Why are you eating grass?"
"We don't have any money for food," the poor man
replied. "We have to eat grass."
"Well, then, you can come with me to my house and I'll
feed you," the lawyer said.
"But sir, I have a wife and two children with me. They
are over there, under that tree."
"Bring them along," the lawyer replied. Turning to the
other poor man he stated,
"You come with us, too."
The second man, in a pitiful voice, then said, "But
sir, I also have a wife and SIX children with me!"
"Bring them all, as well," the lawyer answered.
They all entered the car, which was no easy task, even
for a car as large as the limousine was.
Once underway, one of the poor fellows turned to the
lawyer and said, "Sir, you are too kind. Thank you for
taking all of us with you."
The lawyer replied, "Glad to do it. You'll really love
my place. The grass is almost a foot high
STORY 2:
Mom comes to visit her son Kumar for dinner.....who lives with a girl
roommate Sunita. During the course of the meal, his mother couldn't
help but notice how pretty Kumar's roommate was. She had long been
suspicious of a relationship between the two, and this had only made her more
curious.
Over the course of the evening, while watching the two interact, she
started to wonder if there was more between Kumar and his roommate than
met the eye.
Reading his mom's thoughts, Kumar volunteered, "I know what you must be
thinking, but I assure you, Sunita and I are just roommates." About a
week later, Sunita came to Kumar saying, "Ever since your mother came to
dinner, I've been unable to find the silver plate. You don't suppose
she took it, do you?" Kumar said,"Well, I doubt it, but I'll email her, just to be sure."
So he sat down and wrote :
Dear Mother:
I'm not saying that you 'did' take the silver plate from my house, I'm
not saying that you 'did not' take the silver plate.. But the fact remains
that it has been missing ever since you were here for dinner.
Love, Kumar
Several days later, Kumar received an email from his Mother which read
Dear Son:
I'm not saying that you 'do' sleep with Sunita, and I'm not saying that
you 'do not' sleep with Sunita. But the fact remains that if she was
sleeping in her OWN bed, she would have found the silver plate by now
under the pillow...

hey Dhundhun and everybody else.... thanks for ur precious advice. This forum is really helpful for people like me who do not have much experience with US rules.
Dhundhun, to answer your question...no I do not intend to break the contract. I just want to protect myself from any mishap in future. By the way as I mentioned earlier, the contract is not of 12 months....its for ENDLESS time. It says that if I leave the company anytime...I will need to refund all the training costs that the company would of incurred in last 12 months.

Anybody Travelled with only Advance Payrole through Frankfurt recently please post ?
where they will check for transit visa in usa while boarding or in frankfurt or in india while return ?
My nationality is Indian. Presently i am residing in USA . I have " Advance Payrole Document " . I am planning to travel in this February 2011 from " Atlanta -> Frankfurt -> India(Hyderabad) " and return is in May 2011 from " India(Hyderabad) -> Frankfurt -> Atlanta " in lufthansa airways.
So shall i go for this round trip with a valid " Advance Payrole Document " only ? or i need to have " Air Transit Visa ? If i need Air transit Visa could you please let me know how to apply and what documents i need to submit .
please help already buyed tickets from lufthansa website. non refundable ticket. before that one time i cancelled ticket. airport transit visa shall we apply by post/mail ? in person cant go because very far totally 30 hors drive that too with infant driving not possible . please help ?

Did you get a notice from CSC saying they are transferring your I-485 to NSC? If so, when was it?

So, from the time they received it to time time it took for me to receive the document is 66 days..not bad at all, considering what some other poor folks are going through.
There are other guys here at work whose time line is nearly same as mine, give or take a week. One fellow got his in 50 days. He has travel coing up in the last week on Dec, so he had called to check on his application. During the call he mentioned travel in last week of December. He got the approval email later that day.
My AP got done in time but the EAD was huge headache. God bless our local sentor, who was able to get my EAD expedited, hence was able to avoid the scary job loss scenario.
While it seems like consipracy theory, but I do believe that all these delays are intentional, squarely aimed at making the lives of to-be immigrants so miserable that that they have no choice but to leave.

The legislation would allow some undocumented young people to become U.S. citizens and has been introduced repeatedly over the years with Lugar and Sen. Dick Durbin (D-Ill.) as the cosponsors. The most recent vote on the DREAM Act was in December, when it fell five votes short of bypassing a filibuster. Lugar was one of just three Republicans to vote for the measure.
In a statement, Lugar spokesman Mark Helmke blamed Democrats for turning immigration into a partisan issue.
"President Obama's appearance in Texas framed immigration as a divisive election issue instead of attempting a legitimate debate on comprehensive reform," wrote Helmke. "Ridiculing Republicans was clearly a partisan push that effectively stops a productive discussion about comprehensive immigration reform and the DREAM Act before the 2012 election."
In his Tuesday speech at the Mexico-U.S. border, Obama pointed the finger at Republicans for moving the goal posts on immigration reform. The president argued that his administration has gone out of its way to accommodate their requests.
"Maybe they'll say we need a moat. Or alligators in the moat," Obama joked, referring to the GOP. "They'll never be satisfied. And I understand that. That's politics."
Helmke said Lugar's staff told Democrats that the Indiana senator supported the initiative, but he wanted them to work on getting more Republican support. Lugar's spokesman claims that not only did Democrats not do that, but they set up a press conference to announce the reintroduction of the DREAM Act before the Lugar had made his final decision not to cosponsor. Democrats, however, said that it was clear for months that Indiana Republican wasn't going to cosponsor the bill at this time.
