The Bill has gone too far from what it means.Why didn't the congressman ask the American employers the same questions they asked other big companies.The H1 and L1 classifications allows them for gouging but the bill is not the answer for it.They are trying to show the stats that supports their insane bill.

Sorry to hear about your personal life. If you and your wife agree for filing a divorce petition together, you can file for divorce by mutual consent in India. Both of you have to be present in the court when you file. The judge will decide on the case after a wait time of six months and you may have go back again for the final judgement. There is an one-year separation time that is required before you can file for mutually consented divorce in India. If you are already separated for more than a year, this is the best route.
If not, like some one else mentioned, you can file here but, some states like NY don't have provisions for divorce based on mutual consent or irreconcilable differences. So, it will take up to a year sometimes. It is perfectly legal and valid to get a divorce in the U.S if both of you have signed the petition and have been present at the court.
Your PD is Dec 2003 and so, you have time especially with all the projections that the EB3 quota (India) may retrogress.

No Material Change, except i can go to Canada on business trips without any hassle and dont have to get fingerprinted while re-entering US

Since i had gotten the email from USCIS that its in mail - so no surprises
- How did the long wait upset your life?
I only waited 7 months - so no upsets - even before my GC was filed - i was in US for only about 2 years or so - so no big deal - in those 2 years - my employer did not discriminate in terms of promotions/ pay hikes etc. I had bought a house even before my GC was filed and spouse could work because of my L1 status
- How did immigrationvoice help you during this long wait?
Not Applicable since IV is not really focused (and rightly so) on my GC category
- Would you like to continue your support to immigration voice and help others waiting?
Sure - some of my closest friends are in H1B and i see how the long wait affects them and their families - having said that - i like to make up my mind (rightly or otherwise) about which initiatives are good or bad/ effective or ineffective- so as and when I see initiatives i get excited about like flower campaign, letters to various lawmakers etc- happy to help
- Any advice for everyone?
GC and Citizenship should not prevent anyone from pursuing their career and personal dreams - if not US - there are other countries where your skills would be welcome. Personally - i have given priority to career and family life ahead of visa issues and rest has automatically fallen into place

The "diversity" is a celebrated argument in USA. However, it takes a backseat when doling out amnesty. And "justice" is also important, and you can't sacrifice something as important as Justice for "diversity", which is just a long-term-point-of-view concept
The original intent of the country limits may have been to regulate the system. On the ground level however country limits are actually almost denying (very long wait) retrogressed country folks their GC even if they are similarly qualified. Country limits should have no place in any merit based EB system. I hope that if the amnesty does not have any country limits in CIR atleast EB system should be freed of that, these limits are very restrictive in nature.

I am waiting for GC for buying a house myself. I am sure there are many more people who think this way esp in this market.
I am also waiting for a GC to buy a house ... can't buy on a H1 visa with a project that keeps on getting extended every 3-6 months. You need stability for at least a few years to put in a committment for a mortgage that you are going to pay for 30 years.

Finally I too received my FP notices, however I am scheduled to attend ASC in my attorney's location, I called customer service and now I need to wait till ASC finds an open spot to schedule FP at my location.
What else can you expect from USCIS ??? :rolleyes:

Current Status: Card production ordered.
On June 22, 2007, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.
If you have questions or concerns about your application or the case status results listed above, or if you have not received a decision from USCIS within the current processing time listed*, please contact USCIS Customer Service at (800) 375-5283.
At last after waiting for 5 long years got my GC approved on 22 Jun07!!
Don't want anybody to be stuck in the process for 5-10 years. Will be supporting this team till we reach our goals. And I really hope we do..

Lets just say the announcement is that you can apply EAD/AP once your LC is cleared. Then just like usual USCIS will spend there time precocessing these new applicants and you will have to wait 1 yr just to get EAD/AP.

I know there are some of good <desi> consulting companies..
�there are some of good <desi> consulting companies� �hmm.. debatable. Its like saying there are some good bad-apples. I think there can be grades for desi consultants like little bad, more bad, even more bad, horribly bad, ruthlessly bad�etc but not good.
I don�t think there are any desi consultants who don�t fake their resume at least a little bit. Yeah, even a tiny bit (tiny bit according to consultants mostly will be quite a bit in normal standards) of faking is still faking. So how can you call them good?

Your most compelling argument of preponing your visa interview is that they have opened slots which were not earlier available and you would like to finish this process and keep some time incase some additional documentation was required, you would have the time to get it. Also, there is NO RULE that says you cannot prepone appointment.
Also, I suggested you get a fresh appointment at Mumbai (your original appointment was in Chennai - correct?)

Try to contact FOX, CNN, ABC etc.. that will be helpfull.
It is for all those people (the indian diaspora) who do log on to the online versions of their hometown newspapers to check local Indian news, it might be a pleasant surprise to see the news abt the rally out there!!!
Secondly won't you be inclined to be a part of the rally when your mom or dad friend or a cousin read the news back home and asked you " are you a part this movement" imagine all the non commital people saying ummm ummmm food for thought bloke!!:rolleyes:

I just saw the USCIS GC approval email notice - EB2-I - Dec 20'th 2005 Priority Date
I have same issue as few others have. I'm not married yet. I have applied for GC and luckily the GC has been approved (when I really don't want it to be approved). ... Trust me I was praying god all the time.
My priority date is EB2-I Dec 20'th 2005 and god knows how they approved it much before every one else. When all others really want their GC's.
There are lots people who are in queue with Jan 2004 and later priority dates and whose cases are still pending... How could they approve my case so soon...
I have scheduled for a travel to India on August 15'th 2008 to get married. I wanted to marry and get my wife to USA. I 'm engaged with girl at India and all set for marriage this month (August 2008).
I believe my H1-B has been automatically canceled on immediate approval of GC.
How do I get my future wife to USA?. What are the options left out to me now?.
Please excuse me if this is a duplicate thread. I'm really in hurry and could not check all threads properly.

Recently a friend of mine visited us in Houston and the purpose of his visit was that he surrendered his passports after getting his American Citizenship and waiting for the surrender certificate. He has been waiting for 2 months and still no luck. I am wondering why processing a surrender certificate takes such a long time?
I think that there is no proper process or people are not implementing it properly.
There is no point in fuming over these issues. These have to be resolved and I think that if there are enough people having issues and deal with it, we must do something about it.
As the first step, it would be a great idea to write a list of issues that we all face collectively. The issue must be genuine and real without looking at the emotional angle or with attitude. Do we want to do something to fix these issues?

My labor was filed on July 2004 and I have not received an approval yet.
I got an RFE last week stating that Employeer has to again prove the RIR status of the application.
So Lawyer has started the advertisement process again.
One important issue is over looked here. Small employers will have a tough time in proving I-140 "ability to pay" for employees with older PD�s, whose labor got cleared after Aug 17 from BEC. Cuz the company has to prove its "ability to pay" the proffered wage starting from the date PD is established continuing until the adjudication of I-140.
Suppose the PD for an employee is Oct 2001 and the proffered wage is 80K per annum, then the company should prove that its assets, net income or salary payments were >=80K starting from Oct2001 continuing until the adjudication of I-140.
This is indeed an acid test for small employers.
