Changing to vertical spillover will NOT help EB3 India or China. EB3 ROW is not current and it will suck up all overflow leaving EB2I, EB2C, EB3I and EB3C to their annual quota only. USCIS changing the process to horizontal spillover is the best thing that has happened to I and C community in the absence of immigration reform. Now there is at least some hope for EB3 folks to get a new job and apply in EB2, as at least that queue is faster. If we fight among ourselves and stop vertical spillover, it will only benefit EB3ROW as they will get all overflow from EB1 and EB2ROW. Please guys, let's not fight.
you are from eb2 - I wonder what your opinion would have been if you were from eb3 - India ??? my feeling and hope is that they will start giving more spillover visas to eb3 categories - the reason being that they don't want too much gap between employment categories

Would it be a good idea to mention the costs/efforts involved in this visa stamping tours.
Especially, all dependents including infants/kids need to go either to canada or India forcing to loose 3-4 days of vacation.
Neither of party's ( US gov nor Visa aspirants) are gaining any benefit.

My Job duties on labor says
"Design, develop and test software using Java, C++, C, VB, Winrunner, SAP, Oracle, Networking, ASP and RUP"
The title in labor is "Software Engineer"
Now the new job offer has title as "Lead Developer"
and duties are
"The lead developer will be responsible for leading a team to creating components within Java, utilizing standard Integrated Development Environments (IDEs), writing unit test cases and supporting the Testing and Quality Assurance phases of the software development lifecycle."
Can somebody comment on this in context of same / similar job?
Wow, any company would love to hire someone that is capable of Designing, developing and testing software in Java, C++, C, VB, Winrunner, SAP, Oracle, Networking, ASP and RUP...That's very very versatile....I work on SAP, just SAP, and I already feel like its a ocean. Maybe that's why I'm in EB3.

If this turns out true, that will be great !!!
One minor side effect is that India EB dates might further retrogress because still there a lot of folks with PD 2001,2002 etc pending namecheck clearance.

No lies, salary cannot be raised and people on H-4 cannot work. The article is right.
What I don't get is where they got that the Sept 18 rally will see 5000 of us attending? That's way too little guys, we need at least double that!

By law Employer is required to pay for your labor. You cannot pay for your labor application. Employer can ask you to pay for your I140 which cost around 400 but if you go for premium processing you can pay 1000 extra. There is no other cost involved. To port your date your lawyer sends a letter to USCIS requesting them to consider your EB2 I140 instead of your Eb3 140 which results in your successfuly porting with your priority date still being maintained from old labor

Also, most companies ask for agreements to repay them if we dont stay with them for few years for filing greencard . Is these agreements legal if they ask to repay labor fees ?

All,
We have a head start on Northern CA lawmakers, but we'd like to galvanize the rest of the state.
We have an excel spreadsheet with the district office info of every CA congressperson. We should just start going through that list and meeting at least a lawmaker or two a week in every sub-region.
It would be great if members from Southern CA and Central CA would get involved. Dial-in to the weekly conference call on Thursdays, and find out how we put a lawmaker meeting together, what works and what doesn't, what to take etc.
Also, if you go to the Resources section of the website -- you'll see the new presentation and edited brochure. Check them out and prepare yourself for conversations with legislators and potential members.

Guys.. i'm sick of this nonsense.. I mean this is ridiculous.. this is my second go around in this stupid lottery.. last year I hadn't graduated so they put me in the bachelors quota.. this year the freaking masters quota is full.. i have a genuine offer from one of the big 4 accounting firms.. and have work experience to back it up
i'm sick of these consultant firms.. i wish I could work for the uscis and weed out these miserable cheapsters.. 6 years toiling in their education system, paying the damn taxes, and waiting for 1 smart person to come along and tell them its time to take care of these consultant companies and their consultants who get the jobs based on deceit and conmanship..
simple non sense.. random selection .. my behind..
I really feel like sending flowers to the uscis similar to what the indian folks did last year..

It is easy to visualize a scenario where an activist Latino american citizen, probably acting under guidance by La Raza, purposefully fails to establish his identity and gets arrested. Imagine the media circus once the news outlets find out that an American citizen was detained due to this law.

This is a very valid point. If employer or his lawyer asks more money in fees for filing I485 it is always better to go thro employer if he files I485 promptly. But if the delay is intention of the employer then use your own Lawyer.
USCIS can deny I-485 application if it is missing "initial evidence". In this case it is approved & active I-140 and Employment Verification Letter from GC Employer.
Also, the USCIS published a new rule that allows the USCIS to have more discretion over shortening of the time frame for responses to RFE from previous 12 weeks to any period of time which they see fit.

I am not saying Thanks and Good bye, As you see even after my GC I am still responding to your message. I am fully supporting the VI initiative. but the problem is that USCIS will do only what they think it is right and not what is really right. Me being in the Q for so long , I will never forget the Horrors of waiting for GC, even after getting the GC.
We as indians are divided lots in every area, we are like CRABS. certainly I am not one of those CRABS, My friends will give a ample proof about that.
In matter of fact, As a community, we are not PROUD about OURSELVES and our HINDU CULTURE, we cannot make any DHARMIC efforts to come under ONE UMBRELLA and fight for our cause. IV is one initiative, which is good but not enough, because do we get any help from our Indian Embassy or any Indian Organisation in America to support us, NEVER. this is because we DONOT LOOK UPTO OUR INNER VOICE AS HINDUS. So if I'm understanding it correctly. For all the ones who applied for I-140 after May15th 07 all there petitions will be cancelled or revoked? I really that should come from the USCIS as a amendment and not from a news or a blog. I have been browsing the website and yet to find it. Can someone help me out with the exact text from USCIS? :mad:
